Terms & Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the services (the "service") operated by EriVica Cakes ("EV’s", "we", or "our").

Your access to and use of our service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use our service.

Availability: All orders are subject to availability and acceptance; EV’s reserve the right to cancel your order in the event that supply chain issues occur that result in insufficient stock availability to complete your order or we are unable to deliver to your area due to circumstances beyond our control. In this event you will be contacted as soon as possible and any monies paid will be refunded within 14 days of being notified.

Payment/Deposits: EV’s require a 50% initial non-refundable deposit to secure the order and book a space in our diary for your chosen date. No booking is secure until the deposit has been received and receipt confirmed by us either verbally or via email/messenger. This is applicable to all celebration and wedding cakes ordered from us.

Final payment: Wedding cake bookings: The final payment is due 21 days before the order due date. You will receive a reminder for this payment via email. If the balance remains unpaid EV’s will assume the order is cancelled and any deposit paid will be lost.

Rush orders: Requests made 7 days before order due date may be subject to rush order fees. These fees will be calculated according to the amount of work required to adjust our schedule to accommodate the new order and/or delivery charges for ordering items to reach us in time if necessary. These fees will be added to the total cost of your order and EV’s reserve the right to request payment in full to secure the booking at such short notice.

Changes: EV’s will do their best to accommodate any changes that are made up to 7 days before the order due date. Please note - extra charges may apply to last-minute changes these will be discussed and details provided at the time changes are requested.

Cancellations: Cancelled orders may be refunded minus the deposit and any monies already spent on supplies or work done. If an order is cancelled within 7 days of the order due date or a cancellation is requested after work has been started, there will be no refund.

Postponements /Date changes: EV’s will do their best to accommodate date/venue changes free of charge, however extra delivery costs may be incurred if the new venue is farther than the original venue. EriVica Cakes reserves the right to cancel an order and provide a refund where applicable should we not be able to accommodate a change in date due to the new date being booked already.

Non-edibles: EV’s cakes will occasionally include non-edible items on or in the cake. We will let you know which pieces cannot be eaten. It is your responsibility to ensure they are removed before serving.

Cake design: EV’s cannot duplicate an exact copy of another cake artist’s work as this is their intellectual property but we will try to ensure the look is similar or that the theme of the design is taken into account when designing your cake.

Delivery: Once an order is no longer in our care (delivered or collected) we take no responsibility for any damage caused thereafter. Wedding cakes will be delivered and set up at your venue; we will provide the caterers/staff with any necessary information regarding servings, flavours, non-edibles etc. Once this is done we will photograph the cake as proof of its condition after set-up, after which EV’s will no longer be responsible for any damage caused including from failure to follow instructions provided.

Storage: Our products should be kept in a dry / cool environment at all times. Both storage and allergen information is provided on all packaging and should be adhered to; to ensure that your cake is enjoyed at is best.

Allergies: EV’s are happy to bake using free from ingredients; however we are unable to cater for any dietary allergy as we regularly use products containing, gluten, nuts, dairy and eggs in our baking. All allergens are clearly labelled in bold on the packaging of all our products. Our products may also contain natural dyes, artificial dyes, artificial flavourings, sugar, artificial sweeteners, artificial colour and other allergens not listed.

The Client is responsible for pointing out potential allergy hazards to their guests.

Serving Amount & Sizes: Our assumed serving size is 1 inch(2.5cm) wide x 2 inches (5 cm) long x 4 inches (10 cm) high. Please note that some caterers will portion differently for the aesthetics (the look) of the slice. Portioning is discussed and agreed during the ordering and design process. Serving size estimations are not guaranteed to be exact. EV’s is not responsible for a shortage or increase in the number of portions of cake if the pieces are cut too large/small.

Hire of equipment: The hire of equipment including but not limited to cake stands will incur a small hire charge to cover wear and tear and will also require a fully refundable deposit to be paid and an equipment hire form to be completed. On return of the hired item/s within the set time of 48/72hrs and inspection to ensure its return in good order EriVica Cakes will immediately refund the deposit in full. Should the item/s have sustained any damage then a partial refund or no refund may be given dependant on the level of damage incurred.

Classes / Activity sessions: When booking please ensure you have requested the correct date as changes to dates may not be possible due to class capacity. Payment/deposit is required in full before your booking will be confirmed in writing.

A minimum of 14 days notice (prior to the session date) is required to cancel booked sessions. Alternatively you may provide full details of any person wishing to take your place, however this must have been agreed with us prior to the date of the session. Payments/deposits for all of our classes/activity sessions are non refundable, therefore be certain that you can attend before booking.

If you have recently been unwell with diarrhoea or sickness do not attend any session at the shop until at least 48hrs since your last symptoms occurred and inform us at the earliest opportunity. This is a standard food hygiene requirement and in this instance we will do our best to find an alternative date for you to attend in the future.

Media: We reserve the right to use all photographs of your cake for advertising and promotion purposes. EV’s will make every effort to ensure that the images are not publicised before the recipient receives their cake but cannot be responsible for delays the customer may have in giving the cake. Should images be publicised before your events then please contact us immediately and we will make every effort to remove them as quickly as possible.

Our designs are generally bespoke or uniquely created for each customer. As such all images of our cakes and products including sketches/drawings and photographs remain the intellectual property of EriVica cakes and as such should not be copied, replicated or shared without the express permission of EriVica Cakes.

Drawings of designs will not be provided to the customer until a deposit for the booking has been received.
